A settlement has been reached in the case of an alien woman held in a guarded Polish detention center for six months, with the country agreeing to compensate the victim for all material and moral damages. Dagirat Dzhabrailova, the applicant, had argued that her detention was groundless and violated Article 5 of the Convention on Human Rights (the right to liberty and security). The Court of Human Rights confirmed the settlement between the parties and closed the case.
"The NGOs have indicated for a long time that the detention of aliens in Poland is carried out automatically. The ECtHR’s decision refers to a specific case, but the court will certainly issue similar decisions in similar cases,” said Jacek Bialas, a lawyer for the Helsinki Foundation for Human Rights, one of the NGOs supporting the applicant.
