The Council of State last week annulled decisions by Minister of Economic Affairs Henk Kamp on gas extraction in Groningen. The court considered, among other things, that the minister's interpretation of Article 2 of the ECHR was too strict. Kamp had argued that it requires an acute danger to life, but the judge ruled that he should have assessed whether further restrictions of the gas extraction should have been ordered. The minister's consideration is, therefore, insufficiently motivated. Due to the overlap in positive commitments, the judge ruled similarly relating to Article 8 ECHR.
