Growing marijuana for personal use will remain a penal offense, but buying cannabis illegally for personal use is only considered an administrative offense, according to the March 9 ruling by the Italian Constitutional Court. The decision rejected the question of legitimacy from the Court of Appeal of Brescia on article 73 of the 1990 Drugs Act, and in doing so, the Constitutional Court de facto supports the use of the black market for people who wish to obtain marijuana, instead of decriminalizing the personal cultivation of this substance and efficiently regulating it.
