The Committee on Economic, Social and Cultural Rights has made public its decision (Views) in a housing defense case against Spain. In the case, the individual involved had failed to submit several mortgage repayments, so the bank initiated a mortgage foreclosure proceeding against her. The victim claimed she couldn’t defend her rights in court due to irregularities in notification. The committee concluded that the court failed to take all reasonable measures to adequately notify the woman, which had significant consequences for her right to defend herself.
