Cultivar marihuana para uso personal seguirá siendo delito, pero comprar cannabis ilegalmente para uso personal es considerado solo un falta administrativa, según la sentencia del 9 de marzo del Tribunal Constitucional italiano. La sentencia rechazó la cuestión de legitimidad del Tribunal de Apelación de Brescia sobre el Art. 73 de la Ley de drogas de 1990, y de este modo apoya de facto el uso del mercado negro por parte de las personas que quieren conseguir marihuana, en vez de despenalizar el uso de esta sustancia y regularla eficazmente.
