Interesante sentencia del Tribunal de Justicia de la UE en materia de cuestiones prejudiciales que considera una interpretación más restrictiva de la doctrina del “acto claro”. En el asunto C-160/14,João Filipe Ferreira da Silva e Brito y otros, el TJUE concluye que no es aplicable la doctrina del “acto claro” (Cilfit), y que ante corrientes jurisprudenciales contradictorias a escala nacional, el tribunal supremo debió remitir una cuestión prejudicial al Tribunal de Justicia con el fin de excluir el riesgo de una interpretación errónea del Derecho de la Unión (párrs. 43 y 44).
