A military judge has decided to prosecute five soldiers (one of them a captain) for the crime of torture against two prisoners, committed in 2004 at a Spanish base in Iraq. The proceeding was initiated after a newspaper's 2013 release of a video showing these tortures. It should be noted that despite this being a positive sign that torture is being investigated, it is disappointing that the process is not being carried out by an ordinary court; military jurisdiction should only have powers to solve disciplinary issues, but not to deal with human rights violations.
